New Mexico Cannabis Regulatory Overview

Both the New Mexico House and Senate passed on March 31, 2021 and signed into law by Gov. Lujan Grisham on April 12, 2021, making effective the Cannabis Regulations Act as of June 29, 2021. Retail sales of adult-use cannabis to commence no later than April 1, 2022.

New Mexico Cannabis License Overview

New Mexico will issue 8 types of primary commercial adult-use cannabis establishment licenses: (1) Cannabis Testing Laboratory, (2) Cannabis Manufacturer, (3) Cannabis Producer, (4) Cannabis Retailer, (5) Cannabis Research Laboratory, (6) Vertically Integrated Cannabis Establishment, (7) Integrated Cannabis Microbusiness, and (8) Cannabis Courier.

New Mexico Cannabis Key Regulators

Enabling legislation assigned regulatory authority for adult-use cannabis to the newly created Cannabis Control Division of the New Mexico Regulation and Licensing Department. The Division is required to adopt rules to regulate the marketplace and begin processing license applications by January 1, 2022.

New Jersey Cannabis Locality Options

Municipalities may adopt reasonable time, place and manner restrictions to limit license density and operating times and rules governing smoking and vaping in cannabis consumption areas.
